RENTAL TERMS AND CONDITIONS

1. INTRODUCTION
These Rental Terms and Conditions (“Rental Terms”) govern all rental transactions conducted through the Costume Peti platform (“Platform”) and form an integral part of the Master Terms of Service.
These Rental Terms apply to:
- Customers renting products (“Renters”)
- Inventory owners providing products for rental (“Owners”)
- Costume Peti acting as facilitator, logistics coordinator, and lifecycle administrator
By placing a rental order, Users agree to these Rental Terms.
2. RENTAL MODEL STRUCTURE
The Platform enables temporary possession rights without transfer of ownership.
Key principles:
- Ownership remains with Owner
- Renter receives time-limited usage rights
- Product must be returned
- Product condition must be preserved
- Platform may coordinate lifecycle operations
3. RENTAL ELIGIBILITY
To rent products, Users must:
- Maintain a valid Platform account
- Provide required identity verification (if requested)
- Maintain valid payment method
- Agree to deposit requirements
- Not be restricted from rental activity
The Platform may refuse rental requests based on risk signals.
4. RENTAL PERIOD
4.1 Definition
The rental period begins on the confirmed delivery date and ends on the scheduled return date.
4.2 Calculation
Rental duration may be calculated in:
- Calendar days
- Event windows
- Fixed usage blocks
4.3 Extensions
Extensions may be requested but are not guaranteed.
Pricing adjustments may apply.
5. PRICING AND CHARGES
Rental transactions may include:
- Base rental fee
- Security deposit
- Logistics charges
- Cleaning fee
- Insurance surcharge (if applicable)
- Late penalties
- Damage recovery charges
- Platform service fee
Pricing displayed at checkout shall apply.
6. SECURITY DEPOSIT
6.1 Purpose
Deposits mitigate risk of damage, loss, or late return.
6.2 Amount
Deposit amount may vary by product risk profile.
6.3 Adjustment
Deposit may be:
- Fully refunded
- Partially retained
- Fully applied
Based on inspection outcome.
6.4 Refund Timeline
Deposit refund processing may take several business days following inspection.
7. DELIVERY AND ACCEPTANCE
7.1 Delivery Coordination
Delivery may be executed via logistics partners.
7.2 Acceptance Responsibility
Upon delivery, Renters must:
- Inspect product
- Report defects promptly
- Confirm receipt
Failure to report issues constitutes acceptance.
8. USE OBLIGATIONS
Renters agree to:
- Use products for intended purpose
- Avoid alteration
- Avoid exposure to hazardous conditions
- Maintain hygiene
- Prevent unauthorized transfer
- Prevent commercial sub-rental unless permitted
9. PROHIBITED USE
Renters shall not:
- Modify garments
- Tailor or cut
- Dye or chemically treat
- Use in hazardous environments
- Use in water exposure unless designed
- Transfer possession
- Pledge as collateral
10. CARE AND MAINTENANCE
Renters must exercise reasonable care.
Routine wear is acceptable; negligent damage is not.
Cleaning responsibility may vary by product category.
Platform instructions shall prevail.
11. RETURN OBLIGATIONS
11.1 Timely Return
Products must be returned on or before scheduled date.
11.2 Return Condition
Products must be returned:
- Intact
- Clean (unless cleaning included)
- With accessories
- In original packaging where feasible
11.3 Return Logistics
Return pickup may be coordinated by Platform.
12. LATE RETURNS
Late returns may trigger:
- Additional rental charges
- Penalties
- Suspension
- Deposit adjustment
Continued possession beyond defined tolerance may be treated as loss.
13. DAMAGE POLICY
13.1 Damage Categories
Damage may include:
- Stains
- Tears
- Structural damage
- Missing components
- Alteration
- Irreversible contamination
13.2 Assessment Authority
Damage assessment shall be performed by Platform or authorized agents.
13.3 Recovery
Recovery may include:
- Cleaning charges
- Repair cost
- Depreciated value recovery
- Replacement cost
14. LOSS OR NON-RETURN
Loss includes:
- Theft
- Misplacement
- Non-return
- Irrecoverable destruction
Users may be charged up to replacement value.
15. INSPECTION PROCESS
Inspection may occur:
- At return pickup
- At processing center
- Via photographic documentation
- Via AI inspection systems
Inspection findings shall be final unless disputed within defined period.
16. DISPUTE PROCESS
Renters may dispute:
- Damage assessment
- Deposit deductions
- Late penalties
Disputes must be raised within defined timeframe following notification.
Platform determination shall prevail subject to escalation mechanisms.
17. HYGIENE AND SANITATION
Users acknowledge shared asset lifecycle.
Platform may implement professional cleaning protocols.
Renters shall avoid contamination that cannot be remedied.
18. CANCELLATIONS
Cancellation policies may vary by product and timing.
Charges may apply for:
- Late cancellation
- Preparation cost recovery
- Logistics recovery
19. OWNER RIGHTS
Owners retain:
- Ownership
- Condition expectations
- Recovery rights
- Compensation rights
Platform may act on behalf of Owners.
20. PLATFORM RIGHTS
The Platform may:
- Enforce penalties
- Retain deposits
- Charge payment methods
- Suspend accounts
- Initiate recovery actions
- Adjust risk controls
21. LIMITATION OF LIABILITY
The Platform shall not be liable for:
- Fit or style preference issues
- Event outcome dissatisfaction
- Third-party usage consequences
- Minor wear inherent to rental model
22. RISK TRANSFER
Risk of loss or damage transfers to Renter upon delivery and reverts upon confirmed return processing.
23. INSURANCE
Where insurance products are offered, coverage scope shall be defined separately.
Absence of insurance does not limit liability.
24. FORCE MAJEURE
Uncontrollable events affecting logistics or operations shall not constitute breach.
25. MODIFICATION OF TERMS
The Platform may update Rental Terms.
Continued rental activity constitutes acceptance.
26. GOVERNING LAW
These Rental Terms shall be governed by Indian law.
