1. INTRODUCTION AND ACCEPTANCE
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, “your”) and Costume Peti, including its affiliates, subsidiaries, successors, assigns, and authorized operators (collectively, “Costume Peti”, “Company”, “Platform”, “we”, “us”, or “our”).
These Terms govern access to and use of www.costumepeti.com, associated applications, APIs, tools, features, and services (collectively, the “Platform”), including but not limited to fashion rentals, purchases, resale marketplace services, logistics coordination, inventory monetization, and auction or bidding functionality.
By accessing or using the Platform, you agree to be bound by these Terms and all referenced policies.
If you do not agree, you must discontinue use immediately.
2. PLATFORM NATURE AND ROLE
Costume Peti operates a multi-functional digital commerce ecosystem including:
- Rental facilitation
- Marketplace intermediation
- Direct retail sales
- Inventory monetization infrastructure
- Logistics orchestration
- Auction and bidding facilitation
The Platform may act as:
- Principal seller for certain inventory
- Agent / facilitator for marketplace transactions
- Technology provider enabling transactions between Users
Ownership of listed products may reside with third-party inventory owners.
3. ELIGIBILITY
Users must:
- Be at least 18 years of age
- Possess legal capacity to contract
- Provide accurate information
- Not be prohibited under applicable law
The Company reserves the right to refuse service or terminate accounts at its discretion.
4. ACCOUNT REGISTRATION AND SECURITY
4.1 Account Creation
Users may be required to create an account to access certain features.
4.2 Accuracy of Information
Users must provide accurate, current, and complete information.
4.3 Credential Security
Users are responsible for safeguarding login credentials and all activity under their account.
4.4 Unauthorized Access
Users must promptly notify the Company of suspected unauthorized use.
5. USER REPRESENTATIONS AND WARRANTIES
Users represent that:
- Information provided is truthful
- They will comply with applicable laws
- They will not misuse the Platform
- They have rights to any uploaded content
- Transactions entered are genuine and binding
6. SERVICES OVERVIEW
The Platform may provide:
- Rental booking services
- Purchase transactions
- Marketplace listing functionality
- Inventory ownership monetization
- Auction participation
- Payment processing integration
- Logistics coordination
- Customer support
Service availability may change without notice.
7. RENTAL SERVICES
Rental transactions are governed by separate Rental Terms incorporated by reference.
Key principles include:
- Defined rental period
- Security deposit mechanisms
- User responsibility for care
- Late return penalties
- Damage or loss liability
8. PURCHASE TRANSACTIONS
Purchase transactions may involve Platform-owned or third-party inventory.
Users acknowledge:
- Prices may change
- Taxes may apply
- Availability is not guaranteed
- Returns governed by applicable policies
9. MARKETPLACE SERVICES
9.1 Inventory Owners
Marketplace owners listing inventory represent lawful ownership and authorization to transact.
9.2 Platform Role
The Platform provides technology infrastructure but does not guarantee quality, legality, or condition of third-party inventory.
9.3 Removal Rights
The Company may remove listings for policy violations or operational reasons.
Marketplace participants may be subject to separate agreements.
10. AUCTION AND BIDDING FUNCTIONALITY
Where enabled:
- Bids may be binding
- Anti-fraud monitoring applies
- Bid manipulation prohibited
- Winning bidders must complete payment
- Platform may suspend or cancel auctions
Detailed auction rules may be separately published.
11. PRICING AND FEES
Users agree that the Platform may impose:
- Rental charges
- Purchase prices
- Commissions
- Logistics fees
- Cleaning fees
- Late penalties
- Platform service fees
- Cancellation charges
- Payment processing fees
All fees are subject to change.
12. PAYMENTS
Payments are processed via third-party payment gateways.
Users authorize the Platform and payment processors to charge applicable amounts.
The Platform is not responsible for gateway failures, banking errors, or payment network issues.
13. TAXES
Users are responsible for applicable taxes unless explicitly included.
Marketplace owners are responsible for tax compliance on their earnings.
14. LOGISTICS AND DELIVERY
The Platform may coordinate logistics providers.
Delivery timelines are estimates.
Risk transfer may occur upon delivery as defined in transaction terms.
15. USER CONTENT
Users may upload content including images, descriptions, reviews, and communications.
Users grant the Company a worldwide, non-exclusive, royalty-free license to use such content for Platform operations, marketing, and improvement.
Users remain responsible for legality of content.
16. PROHIBITED CONDUCT
Users shall not:
- Engage in fraud
- Misrepresent identity
- Damage rented products intentionally
- Interfere with Platform operation
- Reverse engineer software
- Use bots or scraping tools
- Upload unlawful content
- Circumvent fees
- Engage in abusive conduct
Violation may result in suspension or legal action.
17. INTELLECTUAL PROPERTY
All Platform materials including software, branding, UI, design, databases, and content are owned by the Company or licensors.
Users receive a limited, revocable, non-transferable license to access the Platform.
No rights are transferred.
18. PLATFORM MODIFICATIONS
The Company may modify:
- Features
- Pricing
- Policies
- Service scope
Continued use constitutes acceptance.
19. SUSPENSION AND TERMINATION
The Company may suspend or terminate accounts for:
- Policy violations
- Fraud suspicion
- Non-payment
- Risk management reasons
- Legal compliance
Termination does not relieve outstanding obligations.
20. THIRD-PARTY SERVICES
The Platform integrates third-party services including payment gateways, logistics, analytics, and communication providers.
The Company is not responsible for third-party service performance.
21. DISCLAIMER OF WARRANTIES
The Platform is provided “as is” and “as available”.
The Company disclaims warranties including:
- Merchantability
- Fitness for purpose
- Non-infringement
- Availability
- Accuracy
22. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
- The Company shall not be liable for indirect, incidental, consequential, or punitive damages.
- Aggregate liability shall not exceed the amount paid by the User in the preceding transaction giving rise to the claim.
23. INDEMNIFICATION
Users agree to indemnify and hold harmless the Company from claims arising from:
- User conduct
- Policy violations
- Content uploaded
- Transaction disputes
- Legal violations
24. FORCE MAJEURE
The Company shall not be liable for delays or failures due to events beyond reasonable control including natural disasters, pandemics, strikes, infrastructure failures, or governmental actions.
25. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by the laws of India.
